1. Rights Holder and Scope

Unless expressly stated otherwise, the rights holder and licensor of the content he creates and provides is:

Andreas Heß
Eikholt 7
18059 Rostock
Germany

Email: license@autonomytrack.eu

This licence applies to Autonomy Track framework, methodology and content components created in-house (“materials of Autonomy Track”). These include, in particular, to the extent legally protected:

  • the Autonomy Track Framework for Digital Sovereignty,
  • the selection, structure and organisation of domains, controls and other taxonomies,
  • Requirements, Questions, Measures, Rubrics, Guidance and Evidence Guidance,
  • assessment, maturity, risk, assurance and scoring methodologies,
  • mapping relationships, mapping rationales and other analyses created by Autonomy Track,
  • Content Packs and their structure, selection and compilation created by Autonomy Track,
  • reporting, presentation and application systems,
  • texts, graphics, tables and other content created by Autonomy Track.

Third-party content is governed exclusively by the respective rights and licence terms. This licence does not claim rights in third-party materials that the rights holder does not hold.

2. Intellectual Property and Reservation of Rights

The materials of Autonomy Track are protected, in particular, by copyright, database rights, trade mark and related rights, contractual restrictions on use and, where applicable, other intellectual property rights.

Any database makers’ rights are also expressly reserved.

All rights not expressly granted by this licence are reserved.

3. Contractually Permitted Use of the Platform and Materials

A customer or user authorised to use Autonomy Track receives, for the duration of that authorisation, a non-exclusive, non-transferable and non-sublicensable right to:

  1. read and use the materials of Autonomy Track as intended within the website, SaaS platform and authorised applications provided,
  2. conduct assessments, prepare decisions and derive internal actions on that basis,
  3. use the designated export and reporting functions.

The rights in section 9 apply instead to assessment reports and result documents. Free guides and working templates are governed exclusively by section 7.1.

Technically necessary temporary copies are permitted to the extent required for intended use. This permission does not promise any particular function or output format.

4. AI Processing Authorised by Autonomy Track

Processing of materials of Autonomy Track by AI and machine learning systems is permitted insofar as that processing forms part of a function provided by Autonomy Track itself or is carried out by service providers authorised by Autonomy Track solely to deliver the contractually intended service of Autonomy Track.

This permission does not give the customer an independent right to transmit materials of Autonomy Track to other AI or machine learning systems.

5. External Processing Using AI and Machine Learning

Unless Autonomy Track expressly permits it in writing or through a machine-readable permission intended for that purpose, it is prohibited to use materials of Autonomy Track outside the authorised functions of Autonomy Track in whole or in part, for or through AI or machine learning systems.

This also applies to protected materials in assessment reports and result documents under section 9. The modifications permitted there do not authorise external AI processing of such content.

This includes, in particular:

  • training or fine-tuning models,
  • prompting or querying with materials of Autonomy Track as input,
  • retrieval-augmented generation (RAG),
  • embeddings and vectorisation,
  • semantic or other automated indexing,
  • automated knowledge extraction,
  • summarisation, translation or rephrasing,
  • classification or automated analysis,
  • automated mapping,
  • benchmarking to build a competing framework or product,
  • creation of derived datasets or knowledge bases.

Uses permitted by mandatory law remain unaffected.

Section 7 remains unaffected.

6. Text and Data Mining

All rights for text and data mining are expressly reserved to the extent permitted by law.

This reservation applies in particular under Article 4(3) of Directive (EU) 2019/790 and section 44b(3) of the German Copyright Act (UrhG).

For materials accessible online, this reservation of use is effective only if expressed in a machine-readable form.

Mandatory statutory exceptions, in particular for privileged scientific research, remain unaffected.

Section 7 remains unaffected.

7. Permission for Public Information and Communications

Content made publicly available by Autonomy Track for general information, corporate presentation, press or marketing communications may be read, linked to, referenced, indexed and displayed with reasonable short excerpts by anyone. This applies across channels, in particular to homepages, landing pages and company profiles, and is not limited to search services. Automated search and discovery use is included to the extent allowed by the machine-readable signals provided.

This permission does not include copying substantial protected catalogues, reconstructing the “Autonomy Track Framework for Digital Sovereignty”, creating a standalone content corpus or use for model training. Protected materials of Autonomy Track do not become freely licensed merely because they are technically accessible. Expressly broader permissions and uses permitted by mandatory law remain unaffected.

7.1 Free Guides and Working Templates

In place of the general sharing rights for assessment reports, free guides and working templates are subject exclusively to the following permission: they may be downloaded, printed, completed in the designated fields and, including those entries, used and shared within the same organisation for its own assessments and procurement decisions. This non-exclusive right of use is non-transferable and non-sublicensable.

Sharing with third parties, including external advisers and legally separate affiliated companies, publication, modification outside the designated input fields, further development or integration into other documents, products, systems or training materials is not permitted. This also applies within the organisation. Incorporating protected content or its structure into the organisation’s own templates is likewise prohibited.

Rights in the guides and their protected content remain with the rights holder. Rights in business information entered by users remain unaffected. A completed guide may be used only within the same organisation. Uses permitted by mandatory law remain unaffected.

8. Prohibited Use

Unless sections 3, 7 or 9 expressly permit the use concerned, the following in particular are prohibited without the rights holder’s prior express written consent:

  1. reproduction or distribution of substantial parts of the materials of Autonomy Track outside the intended use of Autonomy Track,
  2. publication, sublicensing, rental, sale or other distribution of materials of Autonomy Track,
  3. systematic extraction or reconstruction of Controls, Questions, Measures, Rubrics, taxonomies, mappings or Content Packs,
  4. creation of a standalone database or competing framework based on the materials of Autonomy Track,
  5. creation or distribution of derived frameworks or content catalogues,
  6. circumvention of technical access restrictions, entitlements, rate limits or other safeguards,
  7. automated scraping or bulk downloading outside expressly authorised interfaces,
  8. external use for AI and machine learning under section 5.

Section 7 remains unaffected.

9. Assessment Reports and Customer-Owned Content

Rights in customer-owned answers, notes, documents and other information remain with the respective rights holders. Autonomy Track claims no rights in them. The restrictions on permissible customer content in the Terms and Conditions continue to apply.

For assessment reports and result documents lawfully generated with Autonomy Track, including their permitted modifications, the rights holder grants the customer and every recipient the following non-exclusive rights of use:

  1. The documents may be used, reproduced, published and shared with any third parties within and outside the platform without time limit.
  2. For as long as the customer is authorised to use the platform, the customer and recipients may freely modify and update the documents within and outside the platform and use them to create new assessment reports. Valid free platform use is sufficient.
  3. After this platform usage right ends, versions lawfully created up to that point may continue to be used and shared under paragraph 1. Further modifications, updates or new assessment reports based on them are no longer permitted.

Copyright and other rights notices under section 11 must be retained. External AI processing of protected report content under section 5 and extraction or independent reuse of protected content catalogues under section 8 remain prohibited. The restriction on modification does not cover customer-owned content used independently of protected materials. Uses permitted by mandatory law remain unaffected.

10. Third-Party Materials and External Frameworks

Laws, standards, frameworks, open data content and other third-party sources within Autonomy Track may be subject to their own terms of use and licensing.

The relevant source or licence notice takes precedence over this licence for the third-party material concerned.

Content independently created by Autonomy Track in the form of selection, mapping, analysis, structuring or other original work remains unaffected insofar as separate rights exist in it.

11. Attribution and Rights Notices

Copyright, licence, rights, source and provenance notices must not be removed, altered or obscured.

This also applies to machine-readable rights information and provenance metadata.

12. Uses Permitted by Law

This licence does not restrict rights that exist under mandatory law independently of the rights holder’s consent.

In particular, mandatory statutory limitations and exceptions to copyright remain unaffected.

13. Termination of the Right of Use

In the event of a culpable material breach of this licence, a contractually granted right of use may be revoked or terminated in accordance with the applicable contractual terms.

When the right to use the platform ends, the right to modify documents under section 9 also ends. The effective end of the contract is decisive, rather than the notice of termination itself. If a valid free usage relationship continues, the right to modify documents also continues.

The permanent rights in reports and result documents lawfully created up to that point under section 9, paragraph 1 remain in place.

14. Changes and Versioning

This licence may be changed for future versions of the materials of Autonomy Track.

For content already provided under a contract, the applicable licence is determined by the version agreed or incorporated at the relevant time.

Each published version receives a unique version identifier and publication date.

15. Governing Law

German law applies.

If the Customer is a merchant within the meaning of German commercial law, a legal entity under public law or a special fund under public law, the courts of Rostock have jurisdiction to the extent permitted by law.

16. Language Versions

In the event of differences or contradictions between the German and English versions, the German version prevails. Mandatory statutory rights and information obligations remain unaffected.
